1. Acceptance of Terms: By accessing or using the services provided by Xavier Arce Enterprises LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. SMS/MMS Mobile Messaging Marketing Program: We respect your privacy. We will only use information to provide the services you requested.

Program Description: By subscribing to our text messaging program, you agree to receive account updates, appointment reminders, and promotional messages from Service Marketer USA.

Message Frequency: Message frequency varies.

Cost: Message and data rates may apply for any messages sent between us. If you have any questions about your specific text or data plan, please contact your wireless provider directly.

Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the number from which you received the message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Support: If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at [email protected].

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

4. Service Description
Service Marketer USA provides done-for-you AI receptionist systems for home service businesses. Services include AI voice and chat receptionist deployment, lead qualification, appointment booking, CRM integration, and ongoing system support. All systems are custom-built to the client's specific business, services, and pricing. Xavier Arce Enterprises LLC is the sole operator and point of contact for all service delivery.

5. Payment Terms
Services are billed as a one-time setup fee and a monthly retainer as agreed upon at the time of onboarding. Monthly fees are due on the same date each month. No long-term contract is required. Either party may cancel with written notice. Setup fees are non-refundable once system build has commenced. Monthly retainer fees are non-refundable for the current billing period. Xavier Arce Enterprises LLC reserves the right to suspend service for accounts with outstanding balances.

6. Limitation of Liability
Xavier Arce Enterprises LLC provides AI receptionist services on an as-is basis. We do not guarantee specific business outcomes, revenue increases, or lead conversion rates. Results vary by business, industry, call volume, and market conditions. To the maximum extent permitted by law, our total liability for any claim arising from these services shall not exceed the total fees paid by the client in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

7. Governing Law
These Terms of Service are governed by the laws of the State of California. Any disputes arising from these terms or our services shall be resolved in the courts of San Francisco County, California.
